1. Sponsor

The Barkytech Giveaway (the “Promotion”) is sponsored by Allie Tech Media, LLC, operator of Barkytech (“Sponsor,” “we,” “us”), a New York limited liability company, 447 Broadway, 2nd Floor #778, New York, NY 10013. Each edition features a prize supplied either by a participating brand partner (“Partner”) or by Sponsor, as named on the giveaway page at barkytech.com/giveaway (the “Giveaway Page”). In an edition with no Partner, references to Partner in these Official Rules do not apply.

This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, Threads, or X. You understand that you are providing your information to Sponsor and not to Facebook, Instagram, Threads, or X. By entering, you completely release Facebook, Instagram, Threads, and X from any and all liability arising from or related to this Promotion.

2. Agreement to Rules

By participating, you agree to be bound by these Official Rules and represent that you meet the eligibility requirements below. Sponsor’s decisions are final and binding on all matters relating to the Promotion.

3. Eligibility

Open only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry. Employees of Sponsor, the current edition’s Partner, and their immediate family and household members are not eligible, and email addresses owned by Sponsor or used for testing are excluded from the drawing. Void where prohibited.

4. Promotion Period

Each edition runs for the dates stated on that edition’s giveaway post and on the Giveaway Page (the “Entry Period”). Entries received outside the stated Entry Period will not be counted.

5. How to Enter

No entry method requires a purchase. All entries must be completed during that edition’s Entry Period.

(a) Base entry — one per platform. On each platform where the giveaway post appears, as stated on that edition’s post, an entrant earns one (1) entry by: (i) following both the Sponsor’s account and the Partner’s account on that platform, and (ii) commenting on the designated giveaway post on that platform. Only one base entry is earned per platform, regardless of how many comments an entrant posts. An entrant who qualifies on more than one platform earns one base entry per qualifying platform.

Where the Partner does not have an account on a given platform, the follow requirement on that platform is satisfied by following the Sponsor’s account alone.

Sharing, reposting, or tagging others does not earn an entry.

(b) Newsletter entry. Every individual subscribed to the Barkytech email newsletter at any time during that edition’s Entry Period earns one (1) additional entry, credited once per edition and not per platform. Subscribers who joined before the Entry Period began are included and do not need to re-subscribe. A social entry under (a) is not required, and an entrant may hold entries under both (a) and (b).

Eligibility must be maintained through the drawing. An entrant must still be following the accounts required under (a) at the time of the drawing. Following and then unfollowing before the drawing disqualifies that platform’s entries. A newsletter entry under (b) requires the entrant to still be subscribed at the time of the drawing.

Sponsor may verify eligibility at any time. Automated entries, entries submitted by third parties, entries using multiple accounts, and entries that do not follow these Official Rules will be disqualified. Sponsor may disqualify any entrant, in its sole discretion, for fraud, tampering, or any attempt to circumvent these Official Rules.

6. Winner Selection and Odds

Each qualifying entry earned under Section 5 is entered once into that edition’s drawing pool; an entrant who has earned multiple entries appears once per entry. One winner per edition will be selected by random drawing from the pool, conducted by Sponsor within ten (10) business days after the Entry Period closes. Odds of winning depend on the total number of eligible entries received for that edition.

7. Winner Notification

Winner will be notified by reply and/or direct message on a platform the winner entered from or, for a newsletter entry, by email to the subscribed address, within ten (10) business days after the drawing. Winner must respond with the requested information, including confirmation of eligibility and a valid US shipping address, within seventy-two (72) hours of notification, or the Prize may be forfeited and an alternate winner selected. Sponsor is not responsible for any notification that is not received, including as a result of a winner’s privacy settings, message filters, or inactive account.

8. Prize

Winner receives the item featured in that edition’s giveaway post, with its approximate retail value (“ARV”) stated on the Giveaway Page. The Prize is awarded “as is,” with no warranty or guarantee of any kind, express or implied. No cash or other substitution will be made except at Sponsor’s sole discretion, in which case a prize of comparable or greater value may be substituted. Prize is non-transferable. All costs and expenses not expressly stated as included, and all taxes associated with the Prize, are the sole responsibility of the winner. Sponsor is not responsible for any delay or failure in Prize delivery.

9. Rights Granted

By entering, you grant Sponsor and Partner the right, where permitted by law and without further compensation, to use your entry, including comments and any content you post as part of entering, together with your name, city/state, and social media handle, for purposes of advertising, publicity, and promotion.

Acceptance of the Prize constitutes permission for Sponsor and Partner to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

10. General Conditions; Limitation of Liability

Sponsor reserves the right to cancel, suspend, or modify any edition of the Promotion, or these Official Rules, at any time and for any reason, including where fraud, technical failure, or any other factor beyond Sponsor’s reasonable control affects its administration, security, or fairness. Sponsor may select a winner from all eligible entries received prior to and/or after any such action. Sponsor reserves the right to void any entry obtained by means not authorized by these Official Rules.

By entering, you release and hold harmless Sponsor, Partner, and their respective officers, employees, and agents from any liability, loss, injury, or damage arising from or related to your participation in the Promotion or your acceptance, use, or misuse of the Prize, to the fullest extent permitted by law. Sponsor is not responsible for technical failures of any kind, or for entries that are lost, late, delayed, misdirected, incomplete, or not received for any reason.

11. Privacy

Information collected from entrants, including information provided upon winning and any newsletter subscription that earns an entry under Section 5(b), is used to administer the Promotion and, for newsletter subscribers, to send the newsletter, governed by Sponsor’s privacy policy at barkytech.com/privacy-policy.

Sponsor shares the winner’s name and shipping address with that edition’s Partner for Prize fulfillment. Sponsor may share with that edition’s Partner the email addresses of individuals who subscribe to the Barkytech newsletter during that edition’s Entry Period. Sponsor does not sell your information.

Newsletter subscribers may unsubscribe at any time via the link in any newsletter email.

12. Governing Law

This Promotion and these Official Rules are governed by the laws of the State of New York, without regard to conflict-of-laws principles, and without resort to class-action or class-arbitration procedures.

13. Winners List

The winner of each edition is posted on the Giveaway Page at barkytech.com/giveaway, along with the prize and the month, and remains posted on a rolling basis. To request a copy of these Official Rules or a specific edition’s winner information by mail, send a request with a self-addressed stamped envelope to Allie Tech Media, LLC, 447 Broadway, 2nd Floor #778, New York, NY 10013. Requests must be received within ninety (90) days of that edition’s close.
